💻 American Computer Repair Network (ACRN) Advertising Terms and Conditions

1. Eligibility and Enrollment

• Eligibility: The Advertiser must be an officially **registered business with your respective city/county as required by your state laws** and be an operational computer repair business, or a business providing services substantially related to computer repair.
• Accuracy of Information: The Advertiser warrants that all information provided to ACRN for advertising purposes (including, but not limited to, business name, address, contact details, and service descriptions) is true, accurate, and current.

2. Advertising Content and Standards

• Right of Refusal and Appeal: **ACRN reserves the unconditional right to refuse acceptance of any computer repair service for advertising without cause and without needing to provide a reason for such refusal.**
  • Any initial monies paid by a refused service will be **fully refunded within three (3) business days** of the refusal decision.
  • A refused service has the right to appeal this decision by submitting a request to **support@acrn.us**.
• Content Responsibility: The Advertiser is solely responsible for the content of their advertisements and any claims made within them.
• Service Qualifications: The Advertiser warrants that they possess all necessary certifications, proper training, and qualifications required to perform any and all services advertised on the ACRN network. Advertisers are strictly prohibited from advertising services for which they lack demonstrable qualification or certification.
• Customer Complaint Review and Remediation: ACRN reserves the right to review any complaints received from customers gained through their advertising on our network. In the event the Advertiser is found to be at fault and fails to resolve the issue in a timely manner acceptable to ACRN, ACRN reserves the right to suspend or remove their advertisement.
• Immediate Removal for Egregious Conduct: If the incident is deemed by ACRN to be too egregious or heinous (such as fraud, criminal activity, or severe consumer harm), ACRN reserves the right to remove the service listing immediately and terminate the advertising agreement without further notice or refund.
• Content Rights: The Advertiser grants ACRN a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute the advertising materials provided by the Advertiser.
• Prohibited Content: Advertisements must not contain material that is illegal, misleading, deceptive, false, libelous, defamatory, obscene, pornographic, hateful, or that infringes upon the intellectual property or privacy rights of any third party.
• ACRN’s Right to Refuse/Remove: ACRN reserves the right to review, reject, or remove any advertisement that, in our sole judgment, violates these Terms or is otherwise deemed inappropriate or harmful to our network or users.

3. Payment and Billing

• Fees: Advertiser agrees to pay all fees associated with their selected advertising package as outlined in the separate Rate Card or Insertion Order.
• Payment Terms: Payments are due according to the schedule specified in the Rate Card or Insertion Order. **All advertising packages operate on a pay-per-month basis.**
• Declined Payments: **In the event the Advertiser’s payment method is declined or fails, ACRN reserves the right to remove the Advertiser’s listing immediately and without prior notice until payment is fully remedied and current.** Failure to remedy payment within a reasonable time may result in the termination of the agreement.

4. Limitation of Liability

• Service Disclaimer: ACRN provides advertising space but does not guarantee specific performance, sales, leads, or business results from the advertisements.
• No Endorsement: ACRN’s acceptance of an advertisement does not constitute an endorsement of the Advertiser’s products, services, or business practices.
• Indemnification: The Advertiser agrees to indemnify, defend, and hold harmless ACRN from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to the Advertiser’s breach of these Terms, the content of their advertisement, or the services they provide.
• Maximum Liability: In no event shall ACRN’s total liability to the Advertiser for any claim arising out of or related to these Terms or the advertising services exceed the total amount paid by the Advertiser to ACRN for the specific advertisement at issue.

5. Term and Termination

• Term: The advertising term will be as specified in the separate Insertion Order.
• Termination: Either party may terminate the advertising agreement with written notice, subject to any existing payment obligations. ACRN may terminate immediately for a breach of these Terms by the Advertiser, including breaches related to customer complaints (Section 2) or payment failure (Section 3).

6. Modifications to Terms and Conditions

• Acceptance of Updates: **ACRN reserves the right to update these Terms and Conditions at any time, without prior notice. By continuing to advertise with ACRN, the Advertiser agrees to abide by all updated and evolving Terms and Conditions.** The Advertiser is responsible for periodically reviewing these Terms.
